Right now, that’s probably a good thing right? Right now, it’s probably a positive thing. The test is not exactly like that, but it is far different from the SSD questions “Can You Feed Yourself?” “Can You Dress Yourself?” We have obtained full discharges in as little as 60 to 90 days using the TPD Program. We look at someone’s job, their training, their experience, and their actual abilities. Our best chance is to have someone with cognitive issues who is 55 years old or older. My experience as a former employment attorney and my knowledge of the ADA/FMLA helps me to better understand and process these cases. Our streamlined process includes doctors who can see clients via Zoom or at our office in Tampa. It’s possible the test will be applied more rigorously. This is a good thing and should be commended. We don’t also want people to receive this discharge who are not deserving. Our clients have long-term illnesses or injuries that make it nearly impossible to repay their student loans. Income is often not there and hasn’t for a long period of time. A TPD discharge could change your life because it will remove the fear that the government is going to take someone’s social security or other benefits. Even Parent Plus loans are included. We, along with everyone else, will have to wait and see what the changes are. I suspect that we won’t stop in making claims for a TPD discharge, and if anything, the importance of having a student loan attorney on your side, will probably be more important than ever.
