Samsung Challenges Key Patent Innovations Patent, Theseus LF Asset Holdings Entity Launches New Campaign

It was a slow week for new patent filings at the Patent Trial and Appeal Board (PTAB) and above average week for district courts. This week saw only 15 new filings at the PTAB (one PGR and 14 inter partes reviews (IPRs)).

Abbott Diabetes Care, Inc. filed one third of the IPRs at the PTAB, challenging three Dexcom Inc. Patents in five IPRs. Amazon filed two IPRs against one Nokia Technologies OY [associated with Nokia Corporation] patent while Voltage LLC filed two IPRs challenging two Shoals Technologies Group, LLC patents. Pictiva Displays International Ltd. [associated with Key Patent Innovations Limited] had one patent challenged in an IPR by Samsung (discussed below).

What the PTAB lacked in new filings, it made up for with institution decisions, issuing The Board issued 34 IPR institution decisions this week: 6 denials and 28 grants. Of the denied IPRs, three were procedural (one based on patent owner disclaimer and two based on time bars), while the remaining three were denied on the merits.

With respect to institutions, the PTAB granted six IPRs (three filed by Apple and three filed by Apple and Samsung) challenging three DoDots Licensing Solutions LLC [associated with Strategic Intellectual Solutions, LLC] patents. The PTAB also granted institution in four IPRs challenging two Lionra Technologies Ltd. [associated with Magnetar Capital] patents, which were filed by Palo Alto Networks and Fortinet (and in some cases joined by Cisco). The PTAB granted three IPRs filed by Apple Inc. challenging three Geoscope Technologies Ptd, Ltd. [associated with Trhspacific IP Group Limited], CommScope Technologies LLC, and Andrew, LLC [both associated with CommScope Holding Company, Inc.] patents. Additionally, Resmed Corp.—after its IPR challenging a Cleveland Medical Devices patent was denied in September—received a favorable institution decision on that IPR, following a successful in its appeal the Director (who vacated the original decision).

The PTAB also issued seven final written decisions this week, including decisions finding no challenged claims unpatentable in four IPRs challenging Beteiro, LLC [associated with Raymond Anthony Joao] patents. Meanwhile Meta received mixed results in one IPR and was fully successful in a second IPR, challenging two Angel Technologies LLC patents.

While Petitioners may have taken the week off in terms of filing IPRs, plaintiffs picked up the slack in district court, filing 80 new suits. Many of the new cases this week continued campaigns of familiar plaintiffs (associated with familiar monetization entities) continued their long-running campaigns, including: Aml IP LLC [associated with Dynamic IP Deals, LLC (d/b/a DynaIP)] filing two new cases; GeoSymm Ventures LLC [associated with Jeffrey M. Gross] filing six new cases, Push Data LLC [associated with Equitable IP Corporation] filing eight new cases, and Communication Interface Technologies LLC [associated with Equitable IP Corporation] filing four new cases. New cases in ongoing campaigns were also filed by entities associated with Ascend Innovation Management (one new case filed by Accessify LLC and one new case filed by Slyde Analytics) as well as entities associated with Leigh M. Rothschild (Electronic Edison Transmission Technologies, Touchpoint Projection Innovations LLC, and Wyoming Intellectual Property Holdings LLC).

Key Patent Innovations Patent Challenged in IPR

This week Samsung Electronics filed an IPR challenging a Pictiva Displays International Ltd. [associated with Key Patent Innovations] patent. Key Patent Innovations lists three portfolios: Valtrus Innovations (former Hewlett Packard Enterprise Company patents); Malikie Innovations (former Blackberry patents); and Pictiva Displays (former OSRAM patents). In October of last year, Pictiva filed its first lawsuit against Samsung, asserting six patents (generally relating to OLED technology), accusing various Samsung products with OLED displays, including Samsung Galaxy smartphones, as well as computers, tablets, personal wear products, and certain televisions.

Theseus LF Asset Holdings Entity Launches New Campaign

Sandpiper CDN, LLC has launched its first campaign, filing its first case against Google LLC in the Central District of California. Sandpiper asserts six former Level 3 Communications patents and accusing Google’s “Cloud CDN and Media CDN offerings.” On its corporate disclosure statement, Sandpiper identified Theseus LF Asset Holdings, LLC as its parent company.
