Interesting Facts About Bankruptcy in Minneapolis, Minnesota

Bankruptcy is full of fun and interesting facts. This blog will explore a few.

First, contrary to popular belief, you can have an entertainment/fun budget in your case. You cannot go haywire on it, but you are allowed to have some of your household funds go to it.

Second, you can file multiple bankruptcy cases. You cannot file them all at the same time, but you can file more than one. Chapter 7 to Chapter 7 cases, there needs to be eight years from the filing of the first case. Chapter 7 to Chapter 13, needs to be four years from the filing of the first case. Chapter 13 to Chapter 13, there needs to be two years from the filing of the first case. Chapter 13 to Chapter 7, needs to be six years from the filing of the first case. The above timeframes are to receive a discharge, if you have received one in the previous years before filing. Your attorney may also go through filing sooner than the above timeframes and not receive a discharge if this would be beneficial to you.

Third, you have to list everything you own in your asset schedules. This means pets, clothing, jewelry, shovels, rakes, tools, etc. Your assets schedules will need to list all financial and physical property you own or have an interest in.

Finally, you do not have to file a joint bankruptcy just because you are married. It may be beneficial to file just one case, but your spouse doesn’t have to file or could even do their bankruptcy case separately from yours (if they qualify).
