Former top prosecutor in St. Louis ‘remains elusive,’ says state auditor who can’t find her

The former top prosecutor for St. Louis “remains elusive,” and “her whereabouts are currently unknown,” according to a May 6 press release by the Missouri state auditor.

At a news conference Monday, Missouri State Auditor Scott Fitzpatrick said he wants former St. Louis Circuit Attorney Kim Gardner to address evidence of possible “inappropriate expenditures” and “mismanagement” uncovered by auditors.

Publications with the story include the St. Louis Post-Dispatch, KSDK, the Associated Press and St. Louis Public Radio.

Fitzpatrick said his office has tried to find Gardner by reaching out to her lawyers, making repeated calls to telephone numbers associated with Gardner, checking known addresses, and trying to serve a subpoena through a process server.

An audit report will eventually be released, Fitzpatrick said, with or without Gardner’s cooperation.

Gardner resigned in May 2023 after a judge complained that her office appeared to be a “rudderless ship of chaos.” A Democrat, she was first elected in 2016, according to the AP.

Gardner’s resignation also came on the same day that Fitzpatrick’s office was going to court to enforce a subpoena for documents from her office. Her successor gave auditors full access to the office.
