Bankruptcy

Can bankruptcy remove judgments?

Many people wonder if bankruptcy can help them with any existing judgments they may have in relation to collection actions. Creditors often pursue judgments during the collection process, as they allow them to access wages or bank account to collect money from the person who holds the judgement. When considering bankruptcy, it is common for those who are going through the process of bankruptcy to wonder how bankruptcy can help them with any judgments they may have.

This is a question that must be answered in 2 parts: (1) if the bankruptcy will address any underlying debts related to the discharge and (2) if the judgement will disappear through the bankruptcy. Regarding the first question, yes. The bankruptcy discharge can remove the underlying debt related to judgements relating to unsecured debts.

In regards to the second question, whether the judgement will disappear through bankruptcy, the answer is “no”. The bankruptcy will discharge any debts related to the judgment, so it creates the basis for the judgement being wiped out after the discharge. The judgement is not automatically erased by the bankruptcy but can be done so through the expungement process. We can also help you through our 90-day program to repair your credit!
