In a brief order, the justices appointed Kasdin Mitchell, a partner in the Dallas office of Kirkland & Ellis to defend the ruling by the U.S. Court of Appeals for the 11th Circuit in Bowe v. United States. This case will likely be argued in April. In a brief opposing review the federal government agreed that Michael Bowe was wrong when the court of appeals ruled that a federal post-conviction provision required the dismissal of Bowe’s motion for postconviction relief. The federal government, however, insisted that the Supreme Court lacked the authority to review Bowe’s case. It is not uncommon for the justices to appoint an outside attorney. They usually do this once or twice a term. Mitchell will make her first appearance before the court. In 2019, she worked alongside K. Winn Allen who was appointed to be a friend of court in Holguin Hernandez v. United States.
