The Trump Administration’s second term is expected to see a return to a more transactional approach to foreign policy, with heightened openness to deals and aggressive use of trade controls. Boards can expect that the U.S. will continue to use trade controls as an important tool for foreign policy. While specific actions are still uncertain, there is a possibility of significant change on many fronts, such as sanctions relating China, Russia Iran, Syria, and Venezuela.

2024 saw the United States take a number of steps to control trade with Russia and China. Foreign financial institutions (FFIs), companies dealing in semiconductors, microelectronics, and other advanced technologies, and companies dealing in advanced technologies, faced additional restrictions with China. The statute of limitations for U.S. sanction violations was also increased from five years to ten, which exposed companies to greater enforcement risks for historical conduct
