Bankruptcy

Tampa Student Loan and Bankruptcy Lawyer Blog — September 4, 2020

This month, many debt collectors have filed cases. You may have received a recent service. Don’t ignore the summons. If you ignore the summons, a debt collector can easily get a judgement and begin garnishing your wages or bank account. Don’t do it. We call it “low hanging fruits”. They love it when you default. There are many possible defenses. Maybe their paperwork is poor. Maybe they tried to collect too aggressively, and violated consumer laws. They may have waited too long before suing and the statute of limitation expired. Something. You can also settle. A settlement before the win. After they win, they no longer want to settle on terms that you may find attractive.

And after they have a garnishment in place, they are getting paid. They will not accept less. They will not accept installments. How much money do you have to pay the debt in one lump sum? This is the only settlement we see in the post-garnishment phase. You can’t dissolve the garnishment unless you hire us. You may be a single parent. Maybe your earnings come from Social Security.

Bankruptcy? This could be an alternative. There are many people with a lot of debt. We can win a case and fight it, but then another one pops up. Then another. Then another. You can get rid of everything by declaring bankruptcy. Talk to us. We can help you decide what to do next. Only Florida. But perhaps we can help?
