Little Movement in Employment Based Categories, Positive Movement in Family Sponsored Categories — Visa Lawyer Blog — May 13, 2024

The U.S. Department of State’s Bureau of Consular Affairs has published the June Visa Bulletin. In this blog post we breakdown the projected movement of the employment-based and family-sponsored categories in the month of June.

USCIS Adjustment of Status

For employment-based preference categories, the U.S. Citizenship and Immigration Services (USCIS) confirmed that in June it will use the Final Action Dates chart to determine filing eligibility for adjustment of status to permanent residence.

For family-sponsored preference categories, USCIS will use the Dates for Filing chart to determine filing eligibility for adjustment of status to permanent residence.

Highlights of the June 2024 Visa Bulletin

Employment-Based Categories

The June Visa Bulletin shows no advancement in most employment-based categories.

  • The Dates for Filing chart in June remains unchanged from the previous months.
  • The Final Action Dates for EB-1, EB-2, and EB-5 remain unchanged.
  • Only EB-3 India will advance by one week.

Family-Sponsored Categories

For the family-sponsored preference categories, the Dates for Filing Chart remains unchanged from the previous month, with the exception of:

  • F2B Mexico will advance by 2 months to November 1, 2004
  • F3 Worldwide, China, and India will advance by 3 months to September 1, 2010
  • F4 Mexico will advance by 5 days to April 27, 2001

In the Final Action Dates Chart, the following categories will advance:

  • F1 Mexico will advance by 2.6 months to January 1, 2002
  • F2A Worldwide, China, India, and the Philippines will advance by 5.5 months to November 15, 2021
  • F2A Mexico will advance by 2.8 months to February 1, 2021
  • F2B Mexico will advance by 4.2 months to July 8, 2004
  • F3 Worldwide, China, and India will advance by 1.9 months to March 1, 2010
  • F3 Mexico will advance by 4.3 months to December 1, 1999
  • F3 Philippines will advance by 3 weeks to August 22, 2002
  • F4 Mexico will advance by 10 days to February 1, 2001
  • F4 Philippines will advance by 2.8 months to December 1, 2003

Employment-Based Categories

FINAL ACTION DATES FOR EMPLOYMENT-BASED PREFERENCE CASES

According to the Department of State’s June 2024 Visa Bulletin, the following Final Action cutoff dates will apply for employment-based categories (unchanged from previous month except for EB-3 India):

  • EB-1: China will remain at September 1, 2022, and India will remain at March 1, 2021. All other countries will continue to be current.
  • EB-2: China will remain at February 1, 2020, and India will remain at April 15, 2012. The remaining countries will stay at January 15, 2023.
  • EB-3 Professionals and Skilled Workers: China will remain at September 1, 2020, and India will advance by one week, to August 22, 2012. All other countries will remain at November 22, 2022.
  • EB-5: For the EB-5 Unreserved categories (C5, T5, I5, and R5), China will remain at December 15, 2015, and India will remain at December 1, 2020. All other countries will remain current. The EB-5 set-aside categories (Rural, High Unemployment, and Infrastructure) will also remain current.

 Conclusion

DOS Projection – Worldwide Final Action Dates for EB-2 and EB-3 Will Likely Retrogress in July

According to the State Department’s June Visa Bulletin, high demand in the EB-2 and EB-3 categories will most likely require a retrogression in the worldwide EB-2 and EB-3 Final Action dates in next month’s July Visa Bulletin.

The rest of the employment-based categories will like experience little to no movement for the remainder of fiscal year 2024, which ends on September 30, 2024.

The family-sponsored categories should continue to advance especially with respect to the Final Action Dates.
