Medical Bankruptcy in Minneapolis, Minnesota

 As a bankruptcy attorney, I hear all of the time I need to file a medical bankruptcy. Typically this means someone has an abundance of medical debt they want to file a bankruptcy for. Whenever I hear someone mention medical bankruptcy, I clarify, there is no such thing as a medical bankruptcy.

 

Maybe you filed bankruptcy before on only medical debt and maybe that is your only current debt, but there isn’t a specific bankruptcy only for medical debt. 

When you file bankruptcy you need to file on all of your creditors. You cannot pick who to include in the case and who to keep off. This means not only are medical creditors and other unsecured creditors listed in the case, but so are secured lenders. This is true, even if you intend on keeping the collateral secured to the loan. 

Although it is true that those wanting to file a medical bankruptcy have a great amount of medical bills, there usually are other creditors listed in the case as well.
